In general, gambling is illegal in most states. There are varying levels and degrees to which it is illegal, and of course many states will have exceptions to the law. In short though, gambling is not something that most state governments take a favorable view on. With that said, lets take a look at some of the accepted, exempt, forms of gambling that exist in most states.
For most folks who live in the Untied States, the following forms of gambling are either legal in their state or the laws against them are not aggressively enforced:
• Social gambling (home games)
• Lotteries
• Charitable raffles
• Bingo
• Betting on horse or dog races
Some of the key factors in determining whether a form of gambling is legal or not is based issues such as:
• Is the game one of skill or chance? Games of skill will generally be given more leniency than games of chance.
• Are all gamblers on equal footing? If there are no house odds and no house income, the gambling is more likely to be legal.
• How high are the stakes? Penny-ante games are going to be more likely to be legal than $100,000 stakes.
• Where does the gambling take place? Gambling in your own private home will be more likely to be legal than gambling in a public place like a lodge or VFW hall.
Most states, whether gambling is legal or not, will stubbornly adhere to the rule that gamblers must be 21 or over.
